Kentucky House Bill 574, also known as “Baby Miya’s Law,” has introduced new measures that could significantly impact Karine’s ability to retain custody of her newborn. This law establishes a “rebuttable presumption” that any child born to a parent who has previously lost custody of other children is at immediate risk of dependency, neglect, or abuse. As a result, the state is empowered to intervene swiftly, potentially removing the newborn from the parent’s care unless the parent can provide compelling evidence to counter the presumption.
